This Privacy Policy covers Instachart’s policies on the collection, use, and disclosure of Personal Data/Personal Information/Personally Identifiable Information (as defined by applicable law and hereinafter collectively referred to as “Personal Data”) when visitors and Customers (collectively “Users”) access www.instachartapp.com (the “Website”) and/or Instachart’s related mobile applications (collectively the “Platform”) and the Service related thereto.

By accepting this Privacy Policy, you are consenting to the collection, use and storage of the Personal Data pursuant to the disclosures contained within this Privacy Policy.  You may withdraw your consent at any time by emailing us at support@instachartapp.com.

Personal Data Collected by Instachart

We collect certain information about how you use our Platform. For example, we may track when you visit or access our website. Information collected automatically includes:

IP Address and Domain Name. For each User to our Platform, our Web server automatically recognizes each User’s Internet Protocol (IP) address and, when applicable, associated domain name. An IP address is a unique string of characters that identifies any device on the network. Your IP address will generally include information about the city, ZIP code, or area code of your internet service provider (ISP), as well as, to some degree, the physical location and name of your ISP. A domain name is the unique address for a website that usually consists of a website name and a domain name extension.

Device Information. We may collect device-specific information (such as your hardware model, operating system, and mobile network information).

Log information. When you visit our Platform, use our Services or view content provided by InstaChart, we may automatically collect and store certain information in our server logs. This may include:

  • Details of how you used the Platform or our Services;
  • IP addresses;
  • Device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL; and
  • Cookies that may uniquely identify your browser or your InstaChart account.

Location information. When you use a location-enabled InstaChart Service, we may collect and process information about your actual location, like GPS signals sent by a mobile device. We may also use various technologies to determine location, such as sensor data from your device that may, for example, provide information on nearby Wi-Fi access points and cell towers.

We automatically collect and use this type of information to provide or improve our products and services for you and our customers. We do not sell this information.

Beyond the email address Users provide when setting up an account with us, our products and services do not collect or recognize email addresses. Email addresses provided by Users in other fields (such as Notes) may enter our systems; if this does happen, we do not use such e-mail addresses and will take steps to ensure that such information is deleted from our servers. We do, however, collect the e-mail addresses of Users who choose to communicate directly with us via their personal e-mail. In this case, we may retain and use your e-mail address to communicate back with you.

Payment Information 

If you send us payment information (e.g., name, credit card number, billing address etc.), we will collect that information for internal processing only, and then discard it. We do not retain your payment information, and we do not share such information with any third party except to process payment per your authorization.

Other Information Collected 

Certain information about you may be shared with us by third parties. For example, our customers that are long term care providers may share your Personal Information with us in order for us to provide you with an opportunity to use the InstaChart Platform and Services.

If you agree to receive our Services, you might be required to sign up for an account. In order to provide such Service, we must collect, store, and transmit Personal Information about you, such as your name, address, phone number, e-mail address, health information, photos, related facilities, staff, and residents and other information needed to provide the specific Services that you agreed to. Personal Information used for the Services are stored on our third-party data center’s secure computer servers for the sole purpose of authorizing your access and providing such information to you through the Service and to provide you with the intended use of the Service.

Cookies

A cookie is a small piece of data sent from a website or application and stored on your computer or device by your web browser. The file is added once you agree to store cookies on your computer or device, and the cookie helps analyze web traffic or lets you know when you visit a particular site. Cookies allow sites to respond to you as an individual. Our Platform can also tailor its operations to your needs, likes, and dislikes by gathering and remembering information about your preferences.

We use cookies to record session information, such as record User-specific information on what pages are accessed or visited. We also use a third-party tracking service and cookies to track that anonymous data. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyze our Services. You can instruct your browser to refuse all such tracking technologies, or to indicate when it is being sent. However, if you do not accept cookies and certain other tracking technologies, you may not be able to use some portions of our Platform and Service.

Overall, cookies help us provide you with a better Service by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. You can accept or decline cookies. Most web browsers automatically accept cookies, but you can modify your browser setting to decline cookies if you prefer. This setting may prevent you from taking full advantage of the Website.

Embedded content from other websites

Articles on the Platform may include embedded content (e.g., videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the User visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website. You should review the Privacy Policy of such other websites for more information about their specific privacy practices.

How may use your personal information

Instachart is a Business Associate under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) of certain Covered Entities, as that term is defined under HIPAA. Healthcare provider Covered Entities can include senior care centers, skilled nursing homes, and other types of healthcare facilities and companies(“Providers”).  Instachart operates the instachartapp.com Website–the Instachart web portal-for use by such Covered Entities and their Authorized Users, and the Instachart mobile application (the Platform). The Platform may be accessed by authorized third parties. However, your Protected Health Information (“PHI”) may only be accessed by third parties as authorized by the Covered Entity and otherwise only as allowed under HIPAA and other applicable laws that specifically govern how your health information may be used and disclosed. If HIPAA or another applicable law is more restrictive about how your PHI or certain health information may be used and disclosed, then the legal requirements of HIPAA and such other applicable law(s) will control. We will not use or disclosed your PHI or other health information without your signed authorization or consent when it is required. We only use your PHI consistent with each applicable Covered Entity’s HIPAA Notice of Privacy Practices, which you may obtain from your Provider.

With regard to Personal Information that is not governed by HIPAA, this page informs you of our policies regarding the general collection, use and disclosure of your data when you use our Platform and Services, and the choices you have associated with that data. By using our Platform and Service, you agree to the collection and use of your Personal Information as described in this policy.

In general, we will use your Personal Information to provide and improve the Instachart Service, to develop new services, and to protect Instachart and the users of our services.  Personal Information collected may be used to improve the users’ experience and overall quality of our services. We may also need to share your Personal Information with your Providers that are using our Services. We also share your Personal Information with third-party subcontractors who we use to help us perform the Services and for related business operations. We will ask for your consent before sharing any Personal Information with a third party for any purpose except as explained in this Privacy Policy, or unless it is specifically permitted or required by law.

Otherwise, generally, we do not share your Personal Information with companies, organizations, and individuals outside of Instachart unless one of the following occurs:

 

  • Legal Concerns. Personal Information may be shared with companies, organizations, or individuals outside of Instachart if there is a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary, and otherwise legally permitted, to:
  • enforce applicable Terms of Service
  • meet applicable laws, regulations, legal processes or enforceable governmental requests
  • detect, prevent, or otherwise address fraud, security or technical issues and defend rights or property of Instachart
  • investigate wrongdoing in connection with the Services
  • protect personal safety of users of the Services or the public

Sale of Information

We do not sell your Personal Information to third parties.

Deactivating Your Instachart Account

By deactivating your Instachart account, you will be logged out and you will lose access to all Instachart information and its features.

You will no longer receive notifications or communications from Instachart and its users.

While you will no longer be able to access your account, your personal information such as: Name, Email address, Phone number, and NPI # will not be deleted due to legal requirements.

In addition, your/the residents’ medical information and other associated data such as: text communication, concierge requests, and stored legal and medical documents will also not be deleted due to legal requirements.

If you have connected this account to any other organizations, you will no longer be able to see this account’s data in your accounts at those other organizations.

If any other Instachart users have access to your/the residents’ medical information and associated data, they will continue to have access even after your account is deactivated.

If you deactivate your account, you will not be prevented from reactivating your Instachart account in the future.

California Privacy Rights

If you are a California Consumer, you have certain additional state rights to request to disclosure, right to deleted, and right to opt-out of sale rights. For information on your California Consumer Rights pursuant to the California Consumer Privacy Act, California Civil Code Section 1798.100 et seq. (“CCPA”), please see pir CCPA Notice. All capitalized terms contained in this Section or the CCPA Notice which are not otherwise defined here shall have the meaning given to them in the CCPA.

A verifiable Consumer Request may be submitted to us by emailing us at: help@instachartapp.com or through your Instachart account. For each request, Instachart will initially verify the email address on file with the email address submitted in the applicable request. Further verification will be based upon confirmation of data correlating to information maintained by us, as applicable. You may designate an authorized agent to make a request on your behalf. Requests by authorized agents are subject to additional verification requirements pursuant to the rules and regulations set forth in the CCPA. Please see our CCPA Notice for additional information.

Do Not Track

We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

[IF NEED TO BE CCPA COMPLIANT]: Do Not Track” is a feature enabled on some browsers that sends a signal to request that a website disable its tracking or cross-website user tracking. Instachart shall treat any user-enabled global privacy controls, such as a browser plug-in or privacy setting, device setting, or other mechanism, that communicate or signal your choice to opt-out of the sale of your persona information as a valid request submitted pursuant to the CCPA for that browser or device, or, if known, for the consumer.

Compliance with the Children’s Online Privacy Protection Act (COPPA)

Instachart does not knowingly collect personal information from minors, and our Service is not directed at users under the age of 18. If we find that personal information has inadvertently been collected for a minor, we will immediately delete it. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us. We will delete such minor’s personal information from our files within a commercially reasonable time, but no later than required under the applicable law relating to the minor child’s state of residence.

Changes to This Privacy Policy

This Privacy Policy may change from time to time. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, and email notification of privacy policy changes).
